President Trump yesterday announced his intent to re-nominate Rossie David Alston, Jr., of Virginia to be US District Judge for the Eastern District of Virginia and Allison Jones Rushing of North Carolina to be a US Circuit Judge for the Fourth Circuit.
This was unfinished business from the last Congress.
“That’s right,” said Carl Tobias, Law Professor at the University of Richmond. “Judge Alston is a very experienced jurist and he needs a committee vote and a floor vote.”
He says there should be no problems with Alston’s nomination to the Eastern District of Virginia, but the nomination of Allison Jones Rushing is more controversial.
“Yes, she was controversial. Democrats asked her very difficult questions at her 2018 hearing and she is extremely young for appointment to the appellate bench.“
At 36, she would be the youngest judge confirmed on the 4th Circuit Court in the past 15 years.
“My prediction is she will have a party-line vote in committee and a very close vote on the floor.”
