McDonnell Has Concerns With Kagan's Nomination

Governor McDonnell says he has some concerns with Elena Kagen’s nomination.

McDonnell:  I’ve read about her not allowing the military to be on campus during the middle of a two-front war, which causes me some concern.

While Dean at Harvard, Kagen upheld existing policy banning military recruiters from campus, because she believed the military’s “don’t ask don’t tell” policy is discriminatory against gays and lesbians.

McDonnell also cited Kagen’s lack of experience on the bench.

McDonnell:  You don’t really have any opinions or a record to go on to know what her jurisprudence would be, in terms of how well does she follow the law, is she faithful to the constitution.  What I look for in a candidate always is:  do you follow the law, are you not going to be an activist on the right or the left, and will you follow the constitution and the statutes of the United States and apply those faithfully.

Governor McDonnell said he believes the Senate would give Ms. Kagen a thorough and proper hearing.

Should Kagen be confirmed she would be the fourth woman to serve on the Supreme Court.
